Adam sees a DVD player on the porch of Beth’s house, takes the player to his home and tells everyone he owns it. Carol, holding the knife, forces Dan to give her his boom box and runs away with it. Eve breaks into Fred’s apartment, takes a computer and leaves. Which of these acts are crimes and what are the differences among them?
Adam committed theft.
Carol committed assault.
Eve committed burglary.
The least serious was Adam’s crime, because it was only a property crime and generally property crimes are less serious.
Eve committed burglary because she broke inside a dwelling with the intent to commit a crime. Those are generally seen as more serious because you are not only committing a property crime, but invading a person’s dwelling.
Carol committed a violent crime. She put a knife to Adam’s throat and forced him to hand over her property. Although the property was legally hers, our laws do not allow violent defense of property. You can’t shoot and kill someone for example for stealing your stuff. That would be plain murder. We do not reward people for taking the laws into their own hands – especially when it comes to property. Property is replaceable. Killing someone to save your own life when there is no ability to retreat is only allowed because there is not a legal remedy if you get killed so self defense is justifiable, but definitely not in the case of a stolen radio. Although Carol did not use lethal force, the physical force she used is still not justifiable.
